Are hemp products legal for veterinarians to use and sell?

Hemp animal supplements like ElleVet products are legal on a Federal level and in many states for veterinary use and sale. Hemp products that are a food or an unapproved FDA drug are illegal federally, and in many states.

Can the American Veterinary Medical Association (AVMA) or my state’s veterinary medical association revoke or suspend my license for using/selling hemp products?

No. AVMA and state VMAs are voluntary professional organizations with no legal authority to revoke or suspend a veterinarian’s license.

What’s the difference between animal dietary/nutritional supplements and “dietary supplements”?

Animal dietary supplements do not need FDA approval, nor does the FDA regulate this classification of products. While the FDA regulates dietary supplements for humans under the Dietary Supplement Health and Education Act (DSHEA) this does not apply to animal dietary supplements.

Can you provide clarity on the Food and Drug Administration (FDA) statement that there are no approved hemp animal products?

This means that the FDA has not approved any animal products that it regulates (including drugs, food, medical devices) that have hemp oil in them. Because the FDA does not regulate animal dietary supplements, it does not have to approve animal supplements. The FDA also states that hemp products can be legal depending on intended use, labeling, and marketing. For more, see No. 8 on ​this FDA post.

My state veterinary medical board says that it will determine which laws apply in the event a client complains to the board because of an adverse reaction from a hemp oil product — what does this mean?

It means a veterinary medical board will treat hemp like any other product (glucosamine, fish oil, etc.) should a client complain about adverse reactions.
